The Discovery of Chinese Silk and the Silk Road

The Discovery of Chinese Silk and the Silk Road It is well known that silk is discovered in China as one of the best materials for clothing- it has a look and feels of richness that no other materials can match. However, very few people know when or where or how it is discovered. Actually, it could date back to the 30th Century BC when Huang Di (Yellow Emperor) came into power. There are many legends about the discovery of silk; some of them are both romantic and mysterious. The Legend Legend has it that once there lived a father with his daughter, they had a magic horse, which could not only fly in the sky but also understand human language. One day, the father went out on business and did not come back for quite some time. The daughter made him a promise: If the horse could find her father, she would marry him. Finally, her father came back with the horse, but he was shocked at his daughters promise. Unwilling to let his daughter marry a horse, he killed the innocent horse. And then a miracle happened! The horses skin carried the girl flying away. They flew and flew, at last, they stopped on a tree, and the moment the girl touched the tree, she turned into a silkworm. Every day, she spits long and thin silks. The silks just represented her feeling of missing him. Finding Silk by Chance Another less romantic but more convincing explanation is that some ancient Chinese women found this wonderful silk by chance. When they were picking up fruits from the trees, they found a special kind of fruit, white but too hard to eat, so they boiled the fruit in hot water but they still could hardly eat it. At last, they lost their patience and began to beat them with big sticks. In this way, silks and silkworms were discovered. And the white hard fruit is a cocoon! The business of raising silkworms and unwinding cocoons is now known as silk culture or sericulture. It takes an average of 25-28 days for a silkworm, which is no bigger than an ant, to grow old enough to spin a cocoon. Then the women farmers will pick them up one by one to piles of straws, then the silkworm will attach itself to the straw, with its legs to the outside and begin to spin. The next step is unwinding the cocoons; it is done by reeling girls. The cocoons are heated to kill the pupae, this must be done at the right time, otherwise, the pupas are bound to turn into moths, and moths will make a hole in the cocoons, which will be useless for reeling. To unwind the cocoons, first put them in a basin filled with hot water, find the loose end of the cocoon, and then twist them, carry them to a small wheel, thus the cocoons will be unwound. At last, two workers measure them into a certain length, twist them, they are called raw silk, then they are dyed and woven into cloth. An Interesting Fact An interesting fact is that we can unwind about 1,000 meters long silk from one cocoon, while 111 cocoons are needed for a mans tie, and 630 cocoons are needed for a womans blouse. Chinese people developed new way by using silk to make clothes since the discovery of silk. This kind of clothes became popular soon. At that time, Chinas technology was developing fast. Emperor Wu Di of western Han Dynasty decided to develop trade with other countries. To build a road becomes a priority to trade silk. For nearly 60 years of war, the world famous ancient Silk Road was built up at cost of many losses of life and treasures. It started from Changan (now Xian), across Middle Asia, South Asia, and West Asia. Many countries of Asia and Europe were connected. Chinese Silk: a Global Love From then on, Chinese silk, along with many other Chinese inventions, were passed to Europe. Romans, especially women, were crazy for Chinese silk. Before that, Romans used to make clothes with a linen cloth, animal skin, and wool fabric. Now they all turned to silk. It was a symbol of wealth and high social status for them to wear silk clothes. One day, an Indian monk came to visit the Emperor. This monk had been living in China for several years and knew the method of raising silkworms. The Emperor promised a high profit of the monk, the monk hid several cocoons in his cane and took it to Rome. Then, the technology of raising silkworms spread out. Thousands of years have passed since China first discovered silkworms. Nowadays, silk, in some sense, is still some kind of luxury. Some countries are trying some new ways to make silk without silkworms. Hopefully, they can be successful. But whatever the result, nobody should forget that silk was, still is, and will always be a priceless treasure.

How to Make a Great First Impression on Your First Day

How to Make a Great First Impression on Your First Day Starting a new job is an exciting experience, but it can be stressful entering a new work environment with new people and duties. Keep up your  excitement levels and try not to be too nervous. Learning a few tips can help you sail through that day with flying colors. By the end of the day, you’ll feel like a pro. 1. Be on TimeBeing late the first day of your new job can not only leave a bad impression on your new boss but also on the other employees. Set your alarm early the first day of work, and lay out your clothing the night before. That way, you’ll look cool and collected when you arrive for your first day at work.2. Eat Breakfast Before You GoFood gives you energy, and eating a proper breakfast gives you a good start. Leave the sweet rolls in the breadbox, and eat something that will stay with you until lunchtime.3. Introduce YourselfOne way to overcome shyness in a new environment is to introduce yourself to your coworkers. Don’t worry about forgetting n ames. Down the line, you can always say you met so many new people the first  day that you’re still sorting them out, but you appreciate your co-workers’ patience as you learn so many new things. Remember to smile when you speak to someone. A pleasant manner is always welcome and makes you appear cooperative and receptive to others.4. Get OrganizedThe first day at work, you need to check that you have the supplies you need and a clear idea of what you will be doing. Don’t be afraid to ask questions, and make notes at your desk if necessary. While you’re at it, organize your desk neatly. If it’s allowed, don’t forget that framed photo of your family, kids, or pets- its  a good icebreaker to meet fellow employees. However, don’t overdo it. Keep it to one or two photos that are not obtrusive.5. Be AdaptableMaybe you have been assigned work to do first thing in the morning†¦ and then it gets interrupted by more urgent work or a m eeting. Go with the flow, and show how you can be easygoing about sudden changes.6. Dress for SuccessEven if your office or workplace has a laid-back  atmosphere or people dress more casually on Fridays, keep your clothing appropriate. If others in the workplace wear suits, wear one. If others are wearing casual slacks and shirts, copy their example. Whatever you wear, make sure it is clean and neatly pressed. Looking disheveled can cost you the boss’s consideration for promotion.7. Pay Attention to What Others Are DoingIf your coworkers don’t leave on the dot, stay until they start leaving- even if it is quitting time. If you work at a job that serves the public, such in customer service or the medical field,  you must wait until clients are gone or transactions are completed before leaving.8. Ask for HelpBeing assigned your first tasks is an exciting time in a new job. However, if you need help, don’t be afraid to ask for it. If you need to make copies whe n you don’t know where the copy room is located or need help to operate an unfamiliar machine, don’t waste time trying to figure it out for yourself. You don’t need to be a hero!9. Show InitiativeYou’ve been working hard and find you have nothing left to do. What now? This is a good time to show initiative and what a hard worker you are. You can go tell your boss that you have completed your assignments and ask if there is more work that needs to be done. You can also volunteer to do extra assignments when extra jobs pop up.A new job, whether dealing with the public or working in an office such as administrative assistant jobs, requires that you learn your way around a new work environment while maintaining a pleasant relationship with coworkers. TheJobNetwork can help you find that new job by conducting the job search for you. Comparison between two franchises - Research Proposal Paper

Comparison between two franchises - Proposal - Research Paper Example The first is assumed to be Quiznos, a fast food sandwich outlet which offers franchising opportunities for an initial investment of only $5000. The other franchise is Pitapit, which has a much more expensive initial investment, i.e, $255,614 in order to start. The time frame which is assumed for purposes of this research project is ten years and both costs and revenues are evaluated over a ten year period, in order to arrive at a conclusion as to which would be the better business opportunity for an investor over a long term period. One of the first advantages of franchising is branding, wherein a franchisee acquiring an interest in the business is able to offer a strategic identity which has a good market impact. In essence, taking up a franchising opportunity such as Macdonalds for instance, means that the brand is already well known to the public; as a result, any new franchise would have the advantage of attracting customers that have already been subjected to previous promotional efforts from the Company. Since customers are already familiar with the brand name, they are likely to avail of the facilities of the business. In the absence of a franchise, a new business owner would be faced with the task of making the business a recognizable entity in the marketplace, which would involve time and monies. The second advantage of franchising is related to the above. Advertising can often be one of the most expensive aspects of running a business and pulling in customers, with a franchise, the franchise owner takes care of all the advertising and the franchisee merely has to deal with the customers from its own local area. Thus, being a franchisee also means that the business name is a recognized one and the new business franchisee would automatically be able to capitalize on a recognizable brand name in the marketplace. Similarly a franchisee would also have access to the reputation that the franchise has. In the event that the franchise has a good

PBGC Company Profile Essay Example for Free

PBGC Company Profile Essay PBGC is an abbreviation of a Pension Benefit Guaranty Corporation. The purpose of this federal corporation is to protect American’s pension. Its mission is related to protection: Forty four million American workers retirement income is currently being protected in more than 30000 benefit pension plans of private single-employer and multiemployer. Its formation is the result of an act of 1974 by the name Employee Retirement Income Security Act. It has the following objectives: First It helps private-sector define benefit pension plans to be continued and remain well maintained. Second is to provide pension benefits payment time to time, without any interruption. Its third objective is to keep minimum pension insurance premiums. The defined benefit pension plan gives pension on a monthly basis to the retirees but the pension amount is depended upon the salary and the year of services the retirees have rendered. The corporation does not only give monthly payments to retirees up to the guaranteed maximum but also the multiemployer plans participants and one who have not retired yet get financial assistance from it. General Tax Revenues don’t give any kind of fund to this corporation. Insurance premiums financed the operations of this federal corporation which was being set by Congress. Insurance premium is being paid by the sponsors defined for each benefit plan that are basically employers. The recoveries are being made from the companies which would be responsible for the plans in the past. Earnings come from investments for this corporation. According to the plan ended in 2008, workers will get $4,312. 50 monthly when they will get retire at the age of 65. It serves the range of customer’s e. g. general public, media and so on. Board of directors including the Secretaries of Labor (Chair), Commerce and the Treasury guided the operations of PBGC. The two highest priorities of this administration is to reform the defined benefit pension system and bring improvement in retirement security. It contributed in the development of Pension Protection Act of 2006. Since PBGC has worked over the last 33 years for the protection plan of participant’s interests and also to support private pension system’s growth; millions of American workers can now think about secured retirement along with their families. Both the benefit plan and the guarantee by PBGC have made a difference in the lives of the diligent Americans. Annually about $4 million is being given by this corporation to 44 million Americans. The development of the 2006 act not only improved the status of funding of many defined benefit plans but also pension system is being strengthened. Competitive advantage: The corporation has been very effective throughout in managing change over the past few years,’ pension insurance programs have faced many unexpected challenges. The corporation also won an award of managing its work force superbly in this changing business environment. The executive director said: â€Å"We are pleased to be recognized for having the right people, processes and systems in place to manage a doubling of our customer base with no diminution in the quality of our customer service. † (www. pbgc. gov,2008). It was being a first federal agency which got the full certification for its executive evaluation system. It got plenty of awards presented in magazines. These are as under: General Excellence, Service, Competitive Advantage, Global Outlook, Innovation, Managing Change, Financial Impact, Partnership, Ethical Practice and Vision. Weaknesses of PBGC: Weaknesses of PBGC’s certification and accreditation (CA): This would impact the accuracy and completion of information which would affect the credibility of the corporation. It also affects the capability of the corporation to take and manage risks. It compromises agency’s personnel and assets too. There should be an effective CA system to assure security of assets, personnel and operations and that could assure that the corporation is capable enough to meet its functional requirements. The National Institute of Standards and Technology Special Publication 800-37, Accreditation of Federal Information Systems and Guide for the Security Certification provides the framework under 2002 act named as the Federal Information Security Management Act, Public Law 107-347, for how CA program of this corporation should be implemented. Inadequate security policy and plan: The security policy and plan of the current information of PBGC are not according to the guidance provided by National Institute of Standards and Technology Special (NIST) under Federal Information Security Management Act. NIST has developed guidance and standards. It also includes minimum requirement to provide sufficient security of information for all agency assets and operations Change in organizational structure: In 2006 the reorganization of the OIT i. e. ffice of information technology had badly affected the Information System Security Officer’s ability to ensure appropriate operational security for PBGC’s information system. It affected the clarity for officer in terms of his responsibilities and accountability. It made it hard for the officer to establish security standards and procedures. Internal control weaknesses: High risk is being involved in the PBGC’s single-employer pension insurance program. The program had an accumulated deficit of $5. 4 billion in 2003 which was the largest one in history of the corporation. Under funding also increased dramatically in private pension system. The deficit was due to the following reasons: bankrupt firm’s under funded pension plans were ceased, there was a drawback in funding rules, stock market and interest rates decline, companies went global and economy is turned into knowledge based economy. The company had taken steps to improve the internal control for premiums. This is being done for two reasons. First Safeguard of assets: controls must be establish to ensure that cost and obligation are according to the law applicable and assets are safeguarded against any loss or related factors. Second reason is Financial Reporting: it is to ensure that proper reporting is being done of all the revenues and expenditures so that documentation and reports can be made and are accurate. Data Quality Weaknesses: Incorrect data entry, adjustments, and system-generated balances generate errors. Because of the data quality issue, the corporation is unable to ensure the accuracy and completeness of premium data by utilizing Past Due Filing Notices and Statements of Account. The 1st one used to notify plans which had not yet submitted premium filings and 2nd one is used to ensure that underpaid/overpaid premiums from a plan sponsor could be sort out effectively. During auditing it was being noticed that these two tools are not being used timely as it requires significant resources before mailing. Due to this, premiums could not be collected and errors could not be detected. Additionally policies and procedures have not been documented, communicated, or implemented throughout PBGC which is related to the premium accounting cycle. www. pbgc. gov,2008). Business Strategy: The new investment strategy is being formulated to balance risk and return and to improve chances of reaching full funding over the long run. According to this strategy diversified set of fixed-income investments and diversified equity investments both will be given 45% of its assets each and 10% will be given to alternative investment. Financial Information: A deficit of $18. 1 billion was being posted by insurance program for single-employer pension plans in fiscal year 2006. Due to the airline relief provisions in the Pension Protection Act, the corporation managed to reduce its probable liabilities. This led to a $4. 7 billion net improvement. It announces maximum insurance benefit for 2009. The amount would be higher for those who retire later and vise versa. The corporation had a peak year in 2000 when they had a surplus of $10 billion almost which was followed by surplus of $8 billion in 2001. The corporation got the calls in order to stop charging premiums. It got around $9 billion claims in 2002. The claims were because of airline and steel industry. (www. soa. org, n. d. ).

The Importance of Working Together in Groups and Teams Essay -- Teamwo

The Importance of Working Together in Groups and Teams Realizing that a group can become a high performance team is important. Accomplishing this goal is invaluable, advantageous and profitable. Once able to operate from a group to the high performing team is a great step into preparation into the big business world. Leaders and members must also realize not only how to accomplish this but that some problems will and can arise from different demographic characteristics and cultural diversity. That is if one is in such a group, which the probability would be quite high. It is important that members of a group be knowledgeable and skillful in their positions, the degree to which those members can work harmoniously and cooperatively together is equally important and will form into a high performance team. Effective team management plays a high role in building high performance teams. It should always be a question as to what management can do to actively promote successful work teams. Skills and knowledge possessed by every member is also important for a team to become high performance. Although it is among the most important factors, however, it must be coupled with a good working relationship with every team member and good collaboration with every team member. The members who possess the good skills and wide knowledge will be a useful resource to the team if that team member can share their strengths with the other team members and vice versa. It is usually misconstrued that having skillful and intelligent team members is already enough to make a team work right. This kind of thinking is the reason why most teams, despite all of those competent members they have, fail to achieve their goals. A team should establish one common goal, not to think that way and develop a good working relationship with each member. (retrieved from: http://www.strictlysuccess.com, August 18, 2005) This can be done by self awareness exercises, like the DISC assessment and other assess ments or any other kind of self awareness exercises regarding communication style differences. Then these factors and important pieces of information should be taken into full consideration before the actual project is begun. These exercise or assessments can be great ice breakers and mark the difference between a group of individuals merely assigned to a team, as opposed to functioning as... ...of the direction of the project is to come. Whenever demographic or cultural diversity issues become array and cause conflicts and start interfering with the work or projects getting done, just like any other problem inducers, it is the client, the customers, the leaders and or the other stakeholders that are going to be dissatisfied with the results and they are the ones who will experience the negative results. All this may seem a little overwhelming and tiresome to some or to all, but do be assured it is not as hard as it seems. Just keep in mind that you have to embrace the differences between all the demographic characteristics and the culturally diverse team members that make up your group. This with an open mind, and a willingness to cooperate, compromise, and the pleasure to collaborate will harvest many great results and have the organization reaping the many great benefits along with a great top of the line fueled to the rim high performance team. The company was started by Henry Ford in 1903 and is historically famous for the creation and implementation of the assembly line in manufacturing processes. Ford’s mission is to produce and sell automobiles – cars, trucks, SUVs, etc – from the ones initially designed and engineered by Henry Ford all the way through the newer versions created in the last few years. (Profitable Growth for All, 2012) In 2011, the company performed strongly – producing revenues of $134,264,000,000 and net income of $20,213,000,000. Financial data has been gathered from the 2011 annual report and 10-K forms filed with the SEC for further analysis. Appendix A contains these reports and appendix B contains select financial ratios calculated in the analysis. The ratios are divided into six major categories: short-term liquidity, capital structure and solvency, return on invested capital, asset turnover, operating performance and profitability, and financial market measures. All six combine to provide an overall picture of financial health for the company. The below analysis provides evidence that, although Ford’s public stock may be overvalued, the company itself is in good financial health. Company/Industry Description Ford is one of the world’s largest producers of cars and trucks but also engages in other business sectors, particularly vehicle financing, through subsidiaries. The major segments of the automotive production and sales portion include Ford North America, Ford South America, Ford Europe, and Ford Asia Pacific-Africa. Ford Motor Credit Company is the predominant financing subsidiary of the firm. (Profitable Growth for All, 2012) As of 2011, Ford Motor Company’s vehicle brands included Ford and Lincoln; between the two lines, the company sold over 5.5 million vehicles through almost 12,000 dealerships around the world. (Profitable Growth for All, 2012) Since vehicles are durable goods, Ford and the entire automotive industry is highly affected by general economic conditions. Given the 2008 financial crises and its lasting effects, the sale of durable goods has been  relatively low in recent years. In addition to economic factors, Ford must also contend with competitors worldwide. The automotive industry is highly competitive and ever growing in terms of brands and the various vehicles offered by each. The high level of competition within the automotive industry, particularly in mature markets like the United States, has led to a very competitive pricing environment. Competitive pricing in automotive sales tends to surface in the form of price discounts, marketing incentives, and financing incentives to attract customers to a particular brand since vehicles do not tend to be highly differentiated products. In terms of brand recognition, Ford is well known as one of few American car makers still thriving and is probably best known for its pick-up trucks and sports cars, particularly the Mustang. Findings and Assumptions Select financial ratios have been calculated based on Ford Motor Company’s financial statements from 2011 and can be found in Appendix B. The financial statements used for calculations are contained in Appendix A. Based on the calculations, analysis of short-term liquidity, capital structure and long-term liquidity, return on invested capital, asset turnover, operating performance and profitability, and financial market measures are included here. Ford’s short-term liquidity looks promising. The current ratio of 1.16 is good; it shows that the company can pay its short-term obligations 1.16 times. Typically, a current ratio over 1 is considered healthy, though higher is definitely better. (Wahlen et al, 2008) At first glance, Ford’s cash ratio of 0.52 seems a bit weak. It shows that, although the company can meet its short-term debts per the current ratio, it only has enough cash on hand to meet 52% of its short-term obligations. The financial statements included tend to combine cash and marketable securities into a category labeled â€Å"cash and cash equivalents†. If the cash ratio is recalculated using this value instead of simply cash than the ratio improves to 1.10, which shows much stronger liquidity capabilities. Long-term solvency for Ford Motor Company also appears to be strong. The company’s times interest earned ratio of 1.96 means that it can cover its  interest charges on current debt issues almost two times over. This is a good sign that bankruptcy is not eminent and the company is solvent in the long-run. A higher debt to equity ratio means a company gets a larger portion of its financing from creditors than shareholders, though higher is a subjective measure and depends on the industry. (Wahlen et al, 2008) Automotive manufacturers tend to have debt to equity ratios above 2 because the industry is capital intensive. (Debt/equity ratio, 2014) Ford’s debt to equity ratio in 2011 was 10.89, far higher than the industry standard, potentially due to the circumstances of the time. The financial crisis of 2008 resulted in major financial bailouts across the automotive industry. These large levels of debt to the government would increase the debt to equity ratios of all compa nies that accepted the money. In addition to both short and long term solvency, a company’s return on invested capital should be analyzed when determining its financial health. Ford’s return on assets from 2011 is 11.3%. This number seems strong on its own but the best information comes from comparing it to either competitors or previous years in the same company since return on assets varies drastically across industries. (Wahlen et al, 2008)) In 2010, Ford’s return on assets was only 4%. This increase is a significant improvement since the two ratios show that, in 2011, $100,000 of assets would generate $11,300 in income while the same assets in 2010 would have only generated $4,000 in income. Ford’s return on equity in 2011 was 134%, a hugely impressive ratio! This calculation shows that $100,000 in shareholder equity would generate $134,000 in income. Considering the ROE in 2010 was negative, this is an extreme improvement in profitability for the company. In 2010, Ford’s asset and inventory turnover ratios were excellent. The total asset turnover of 74.9% shows that the company is effectively deploying their assets and has been able to generate $74,900 profit for every $100,000 in assets. This is not surprising considering the high return on assets analyzed earlier. Days sales in inventory for Ford in 2011 was only 19 days – meaning the company could convert inventory to sales in less than 3 weeks. Like return on assets, the acceptable level of inventory convertability varies drastically from one industry to another. (Wahlen et  al, 2008) In recent years, automotive companies have averaged over 60 days for this inventory ratio. Ford’s 2013 days sales in inventory was almost 90 days and increased by 26% to over 100 days in January of 2014. These increased numbers are likely a result of the slow economic recovery and consequential decrease in car sales. (Young, 2014) Operating performance and profitability ratios, including fixed asset turnover ratio and operating performance ratio, also show financial strength for Ford Motor Company. The fixed asset turnover ratio of 5.62 shows that the company is able to generate significant revenues from fixed assets, i.e. property, plant, and equipment. Ford’s operating performance ratio of 15.06 also shows that the company is performing strongly. Ford’s price-earnings ratio of 3.15 means the company’s stock was trading at 3 times the earnings value as of December 31, 2011. This shows that investors were willing to pay 3 times its worth to own Ford stock, signifying that earnings growth was expected. The market-to-book ratio of 4.23 means that the market value of the stock is 4.23 times the book value of the same stock. In other words, Ford’s stock was overvalued in excess of 4 times its book value. Crucial Factors Many crucial factors play a role in analyzing a company’s financial situation. Some of these factors are internal – such as management, particularly changes in management, and the business model. Other factors are external – examples include governmental action, competitors, and the overall economic state. The above analysis of Ford Motor Company incorporated numerous crucial factors when interpreting the selected ratios and their piece in the overall financial health of the company. Conclusions Overall, Ford Motor Company seems to be in good financial health as of the end of 2011. Both short and long term solvency are strong, particularly when marketable securities are included in the cash ratio calculation. Ford’s capital structure is heavily tilted towards creditors, though this is likely due to the governmental bailout and lack of investors in the slowly recovering stock market. Return on assets and return on equity are both  impressive, particularly when compared to data from the previous year. In 2011, Ford had excellent asset and inventory turnover statistics. Unfortunately, these have since declined – most likely due to the decrease in automotive sales in today’s slowly recovering economy. Operating performance and profitability standards both show financial strength and good performance, though the financial market measures indicate that investors may be more ambitious than they should be about the performance strength. Adjectives Synonymous with Best

Adjectives Synonymous with Best Adjectives Synonymous with Best Adjectives Synonymous with Best By Mark Nichol A recent post discussed nouns employed to refer to ultimate achievement. Here, you’ll find details about adjectives that describe something that is the best, highest, or most important. Cardinal is from the Latin term cardinalis, meaning â€Å"essential† or â€Å"principal.† Chief, meaning â€Å"highest in authority† or â€Å"most important†- by way of the Anglo-French word chef, still used in French and English as the title for a professional cook in charge of a kitchen- comes from the Latin word caput, whence capital and captain as well. Foremost, interestingly, is not a compound of fore and most; its derivation is the Old English term fyrmest or formest, meaning (and related to) â€Å"first.† (The -est ending is the same superlative suffix seen in highest, smartest, and so on; see below for a mention of superlative.) Paramount, ultimately derived from the Latin phrase per ad montem (â€Å"to the hill†), means â€Å"superior to all others.† Preeminent, from the Latin adjective praeeminere, meaning â€Å"to be outstanding,† means â€Å"better than others† (eminent, the word without the prefix, means simply â€Å"respected† and â€Å"successful†); the root is also seen in prominent, and all three words are distantly related to mount and mountain. Premier and primary both come from Latin primarius, meaning â€Å"excellent, of the first rank,† which in turn is derived from primus, meaning â€Å"first.† From that word we also get prime, which, among other things, means â€Å"first-rate†; the Italian and Spanish adjective primo is sometimes used in informal English to denote something excellent. Premium, distantly related, means â€Å"high† or â€Å"higher than normal†; it stems from the Latin noun praemium, meaning â€Å"reward,† which is the meaning of the noun form. (The adjectival form, which developed less than a hundred years ago, was originally applied to a better grade of butter.) Superior, meaning â€Å"higher,† comes directly from Latin and stems ultimately from the Latin word super; supreme, from the Latin word supremus, meaning â€Å"highest,† is related. Another related word is superlative, ultimately from superlativus, meaning â€Å"exaggerated† or â€Å"extravagant.† (A superlative is also the ultimate form of an adjective, such as largest, the superlative of large; larger is the intermediate comparative form.) Best is itself a superlative; its comparative is better, but oddly, they are intensifications not of a word beginning with be- but of good (to make up for the lack of gooder and goodest as options); the base adjective was originally bot, which survives only in the form of boot in the idiomatic phrase â€Å"to boot,† which roughly means â€Å"in addition.† Want to improve your English in five minutes a day? Justice System in the UAE Research Paper Example | Topics and Well Written Essays - 5000 words

Justice System in the UAE - Research Paper Example † (Judicial System in Abu Dhabi par 13) on the other hand, Ras Al Khaimah does not have a Court of Cassation. The major source of law is legislation. The UAE mainly follows the system of civil law, inspired by the French and Roman legal systems as well as the Egyptian law of civil codes. The court system is generally inquisitorial, unbound by precedent and comprised of specifically skilled judicial officers. Despite being a federation of United Emirates, the judicial scheme is not all-inclusive or wide ranging, as some of the emirates have their own self-governing judicial systems. In spite of being an Islamic nation, the application of Shari’ah law is controlled and contractual as well as commercial transactions are controlled by written commercial laws and codes that can be relied upon by the needs of western businesses. The Justice system: The Justice system in the UAE is mainly based on the Constitution of the UAE? 1971 (Constitution). The federation has control over all affairs assigned to it in the Constitution. Each individual member of United Emirates has power over their own territories in all matters? rather than just the exclusive authority of the federation, as set out in the UAE Constitution. Additionally, every Emirate has a hereditary sovereign who exercises substantial control over his own Emirate. The 7 rulers, as members or associates of the Supreme Council, jointly exercise control over the UAE. The Sharia civil law systems are the chief sources of legislation (Constitution). Civil law system: The UAE functions in civil law statutes and such systems are the primary source of law. Decisions of the high courts in the UAE are not based on any decisions made by low courts. â€Å"In litigation matters, the pleadings submitted by the parties - plaints or written statements - play a determining role as the courts generally decide cases based upon them† (Latheef par 4). Every case is discussed and a decision is reached based on it s own facts and merits. Every proceeding in the court is in Arabic. All Non-Arabic documents filed in the court by appellants are to be converted into Arabic by a translator licensed by the Ministry of Justice. The Sharia: Generally, the Sharia is a body of ethical, religious and legal rules. The fundamental and basic roots of Islamic Sharia are: The Koran? which is a compilation of divinely ordained policies. The Sunna that includes the teachings of Prophet (Hadith), as well as an account of his proceeding and actions. Sharia is established on well-known concepts of equity and justice, and its practical effect in commercial matters is frequently the same as would be attained in Western law. â€Å"To say that the Shari’a should govern judicial decisions is to refer to a process rather than to specify a result. Shari’a itself includes different schools of thought on a number of legal issues. However, it is founded on familiar concepts of justice and equity, and the pra ctical result in commercial matters is often, though not always, the same as would be reached under Western jurisprudence† (United Arab Emirates par 257). For example, Sharia strives to provide effect to the party’s intention in matters of contract. On the other hand, the intention of the party may be in a different way construed by jurists in the two systems. For instance, one researcher has argued convincingly that in many cases? traditional Sharia would let go the parties
